CMS urges covered entities to file for HIPAA extension - Updata - Centers for Medicare and Medicaid Services
CMS is strongly encouraging all HIPAA-covered entities to file for a one-year extension of the compliance deadline for HIPAAs transactions and code sets standards and to test their plans for compliance with the new standards as soon as possible. HIPAA requires compliance with the standards by October 16, 2002. However, the Administrative Simplification Compliance Act allows covered entities a one-year extension if they submit a compliance plan by October 15, 2002, "either by paper or-preferably--electronically." By filing for the one-year extension, healthcare providers will have until October 16, 2003, to become compliant with the HIPAA transactions and code sets standards. After filing for an extension, organizations are not locked into meeting every deadline on the timetable submitted with the filing, according to Karen Trudeau, CMS spokesperson for the compliance extension plan. Submitting the compliance extension plan does not mean there is a commitment to do certain things by certain dates. "No one will audit to make sure you're meeting those dates," says Trudeau. "Also, if you're not quite sure if you are a covered entity, it is acceptable to submit a compliance extension request. It does not lock in your status one way or the other."
HIPAA was passed by Congress in 1996 to implement the use of standard formats for transmitting claims and other ad ministrative transactions by healthcare providers, health plans, and clearinghouses that transmit transactions electronically. These standards are intended to simplify transactions, improve efficiency, and encourage the electronic performance of healthcare transactions.
